MUNICIPAL COUNCIL

According to Law 3852/2010 (Kallikratis Programme), nowadays, the Municipal Council consists of 49 Municipal Council Members who are elected every 4 years. Twenty-one of these belong to the majority party (i.e. the one that prevailed in the elections), which is headed by the Mayor. The remaining 20 belong to the 10 minority parties. Each minority party is headed by the council member who was a candidate for Mayor.

The Bureau is elected every two years, following a call by the council member of the successful party that has been elected with the most votes, and in case of a tie of the one who is first in order in the court decision. The President is nominated by the majority party, the Vice President is nominated by the most successful minority party, while the Secretary by the other minority parties, and in the event that there are none they are nominated by the majority party.

The Municipal Council meets at least once a month, following a call by the President. According to Article 67 of the Municipal & Community Code (Law 3852/2010) “The President also calls a meeting of the Council through a written invitation, where the issues of the agenda are outlined, whenever requested by the Mayor or the Finance Committee or the Quality of Life Committee or at least by one third (1/3) of the total number of members of the Council or by all minority council members”. The call is published on the website of the Municipality and it is served or communicated to the council members at least three (3) full days prior to the day the meeting has been scheduled for.
The President of the Municipal Council draws up the Agenda in which they are required to outline all issues put forward by the Mayor, the Executive Committee, as well as the Finance Committee and the Quality of Life Committee. Even without prior discussion, following a relevant proposal by the President or the Mayor or the Head Council Member of a Municipal Party, provided that there is absolute majority of the total number of its members, the Municipal Council has the right to decide that an issue which is not part of the agenda is urgent and that it can discuss and decide on it by the same majority, prior to commencement of discussion of the agenda issues.

The meetings are public and minutes are kept in each meeting.

The Council has a quorum when at least half plus one of its members are present. It takes its decisions by absolute majority of those present, unless otherwise specified.

Each decision is assigned a specific number, and at the beginning of each year the numbering of these decisions is reset. Three (3) days after the meeting of the Municipal Council, a table is published in which the issues discussed, the number of decisions and a summary of their content are outlined.

Anybody having a particular legitimate interest can request in writing for certified copies of the minutes and decisions in question, or to be fully informed about them, if it is not feasible for copies to be issued.

Under the responsibility of the President of the Municipal Council, all decisions of the Municipal Council can be posted on the Municipality’s website. Non-publication of the decisions on the website does not constitute grounds for invalidity of the decision. The decisions taken by the Municipal Council are sent to the competent departments for their implementation, and some of them are sent to the Legality Auditor in order to undergo a legality audit.

The Municipal Council:

  • discusses and decides on all issues concerning the Municipality, apart from those legally falling within the responsibilities of the Mayor or another body of the Municipality or those that the Municipal Council itself transferred to one of its Committees.
  • expresses its positions on issues of local interest and gives its opinion whenever requested to do so by public authorities or competent bodies.
  • sets taxes, fees, entitlements and levies, following a recommendation by the Finance Committee.
  • draws up its Rules of Procedure, by absolute majority of its members, on the basis of the model Rules of Article 67 herein.
  • one (1) month prior to elections taking place and until new municipal authorities have taken over, the Municipal Council only decides on issues related to cases of extreme urgency and unforeseen necessity.
  • can issue a decision to transfer to the Quality of Life Committee certain of its responsibilities which are related to the Committee’s competencies.
